SELECTION CRITERIA FOR BUSINESS IMMIGRANTS



To be eligible for selection as business immigrants, applicants must first meet the definition of the class to which they are applying (investor, entrepreneur, self-employed). Applicants are then assessed against five selection criteria and must obtain a minimum of 35 points.

Important notes:

1.    Selection is based on the documents provided and the qualities of the applicant, as assessed against the selection criteria. An interview may be required. A visa officer will ask the applicant to explain any ambiguities, inconsistencies, shortcomings or gaps in these documents during the interview.

2.    The pass mark on June 28, 2002 is 35 points for all business immigrants; however, the pass mark can change at the direction of the Minister.

3.    All dollar amounts cited in this fact sheet are in Canadian dollars.

A BALANCED IMMIGRATION PROGRAM

 

THE PILLARS OR STREAMS ARE MEAN TO BALANCE TWO THINGS: (A) CANADA'S ECONOMIC SELF-INTEREST AND (B) CANADA'S AVOWED GENEROSITY AND COMPASSION -- AND OFFER OF SAFE HAVEN TO OTHERS AROUND THE WORLD.

PROBLEM OF BALANCE: THROUGH OUT HISTORY OF IMMIGRATION TO CANADA RARELY HAVE A FEW YEARS GONE BY WITHOUT THE EVENTS OF THE DAY ENTICING SOME NEW AMENDMENT TO THE IMMIGRATION LAW.

SO THE HISTORICAL CHARACTERISTIC OF IMMIGRATION LAW, AND IMMGRATION STEAMS IS THAT THEY HAVE BEEN IN "CONSTANT FLUX".

(THE HIGHEST LEVELS EVER: 330,000 IN 1911 AND 400,000 IN 1913. 174,000 CAME IN 1998.)

FOR THE SIXTH YEAR IN A ROW, THE DEPARTMENT'S ANNUAL REPORT CONFIRMS THAT CANADA BEAT ITS IMMIGRATION TARGET LAST YEAR, ACCEPTING 262,236 NEW PERMANENT RESIDENTS IN 2005, JUST ABOVE ITS TARGET RANGE OF 220,000 TO 245,000. THAT'S UP 11 PER CENT OVER THE 235,824 RESIDENTS ACCEPTED IN 2004.

NEXT YEAR, CANADA HAS SET A GOAL OF ADMITTING BETWEEN 240,000 AND 265,000 NEW RESIDENTS, ACCORDING TO THE REPORT TABLED IN THE COMMONS.

(A)     CANADA HAS BEEN PRONE TO A "TAP-ON/TAP-OFF LEVELS OF INFLOW -- MEANING IT HAS HISTORICALLY CHANGED WITH THE STATE OF THE ECONOMY. (CYCLICAL: BAD ECON. LESS INTAKE).

(B)     IN THE MODERN CONTEXT "HAS MADE LONG-RANGE PLANNING" MORE "DIFFICULT" AND CAUSES PROBLEMS FOR THE ADMINISTRATION OF CANADA'S IMMIGRATION POLICY.

(C)    (IT IS FURTHER SUGGESTED) THE "VOLATILITY" OF IMMIGRATION INTAKE IN CANADA IS NOT ONLY UNNECESSARY, BUT IT MAY BE COUNTERPRODUCTIVE --

EX: IF IMMIGRATION LEVELS HAVE LITTLE EFFECT ON CANADA'S ECONOMY AND POPULATION STRUCTURE, THEN THERE IS LITTLE TO GAIN BY CONTINUALLY CHANGING THE LEVEL OF INFLOW.

IF CONSIDERATIONS OF POP. SIZE AND STRUCTURE ARE IMPORTANT FACTORS IN SETTING THE LEVELS OF IMMIGRATION, THEY ARE BY NATURE "LONG-TERM" AND SUPPORT A RATIONALE FOR A CONSTANT LEVEL OF INFLOW RATHER THAN A CYCLICAL ONE (CLOSELY TIED TO THE STATE OF THE CANADIAN ECONOMY).

 

ALL OF THIS POINTS OUT THE PROBLEM OF DETERMINING WHAT THE OBJECTIVES OF CANADA'S IMMIGRATION POLICY SHOULD BE -- THERE IS NO PUBLIC DIALOGUE ON (NO "COMPREHENSIVE" PLAN FOR IMMIGRATION AND NATIONBUILDING).

TAKES IN .04% OF THE WORLD'S REFUGEES AND REPRESENTS ONLY .01% OF THE TOTAL POPULATION. (DON'T JUDGE YOURSELF BY BARBARIANS).

6)      LIVE IN UNPOPULATED AREAS? - VARIOUS ATTEMPTS TO SEND NEWCOMERS TO UNPOPULATED AREAS HAVE ALL BEEN DETERMINED TO BE UNCONSTITUTIONAL. VIOLATION OF CHARTER OF RIGHTS AND FREEDOMS (OF PERSON).

NEW IMMIGRATION BILL C31

1.     IMMIGRATION BILL TABLED BY THE LIBERAL GOVERNMENT IS HIGHLIGHTED BY PLANS FOR A $1 MILLION FINE AND A LIFE SENTENCE FOR ALIEN-SMUGGLING.

2.     KEY CHANGES TO THE REFUGEE DETERMINATION SYSTEM INCLUDE A NEW “FRONT-END” SECURITY CHECK IN WHICH REFUGEES ARE SCREENED IMMEDIATELY UPON ENTRY INTO CANADA INSTEAD OF AFTER A LENGTHY HEARING PROCESS.

3.     BILL C-31 ALSO BETTER SPELLS OUT CRITERIA FOR DETAINING MIGRANTS. THOSE WHO ARE A THREAT TO FLEE OR POSE A DANGER WOULD BE AUTOMATICALLY DETAINED.

4.     OTHER KEY STREAMLINING PLANKS OF THE LEGISLATION INCLUDE,

·        REDUCING THE LENGTH OF TIME IT TAKES A REFUGEE TO HAVE A CASE HEARD FROM FIVE YEARS TO THREE;

ENSURING REFERRALS OF CLAIMS TO IMMIGRATION REFUGEE BOARD WITHIN THREE WORKING DAYS; AND

·        DESIGNATING NEW FUNDS TO CLEAR UP BACKLOGS.

 

4.     BILL C-31, THE IMMIGRATION AND REFUGEE PROTECTION ACT, WOULD ALSO MAKE IT – ]

A) EASIER TO DEPORT CRIMINALS WHO SLIP INTO CANADA,

B) TIGHTEN IMMIGRATION AND REFUGEE RULES,

C) INCREASING OVERALL REGULATORY CONTROLS, AND

D) CURTAIL THE APPEALS PROCESS.

 

 

CRITICISMS:

1.     LAWYERS AND IMMIGRANT GROUPS, HOWEVER, HAVE BEEN QUICK AND UNEQUIVOCAL IN CONDEMNING THE BILL AS MEAN-SPIRITED AND POSSIBLY UNCONSTITUTIONAL.

2.     MEDIA REPORTS INDICATE, THAT UNDER THE UMBRELLA OF “CANADIANS FOR A FAIR AND JUST IMMIGRATION POLICY,” MORE THAN 50 COMMUNITY-BASED ORGANIZATIONS, INCLUDING THE BAR ASSOCIATION, HAVE PUBLICLY OPPOSED THE PROPOSED BILL.

3.     THE NEW LAW WOULD TAKE AWAY THE DEPORTATION APPEAL RIGHTS OF ANY PERMANENT RESIDENT CONVICTED OF MINOR CRIMES.

4.     CHANGES GIVE THE IMMIGRATION DEPARTMENT MORE POWER THAN CSIS (CANADA’S SPY AGENCY).

5.     IT WILL REMOVE ALL OVERSIGHT ON SECURITY MATTERS.

6.     TIGHTENING THE SCREWS ON INTERNATIONAL IMMIGRATION MAY ALLEVIATE SOME SHORT-TERM PUBLIC ANXIETY, BUT IT IS NOT NECESSARILY CONDUCIVE TO CONTINUED SOCIAL PROGRESS (?) –

IN THE SHORT TERM, YOU CAN PLUG-UP THE HOLES AND REINFORCE THE BORDER PERIMETERS AS A TEMPORARY STOPGAP AGAINST INTERLOPERS –

IN THE LONG-TERM, SINCE THE GLOBAL VILLAGE IS BECOMING HIGHLY VOLATILE, WITHOUT INTERNATIONAL INTERVENTION AND COORDINATION, SOCIOLOGICAL PREDICTIONS ARE THERE WILL EVENTUALLY BE THE BIGGEST INTER-ETHNIC BONFIRE AND WEENIE-ROAST OF ALL TIME, AND LIKE IT OR NOT CANADA IS GOING TO BE INVITED.

CONCLUSION: (POPULATION BOOM!!!)

--       CANADA CANNOT ESCAPE THE CLAMORING HOARDS

       THE WORLD POPULATION IS ALREADY DOUBLE WHAT IT WAS IN 1950.

       IT IS PROJECTED TO BOOM BY ANOTHER (3) THREE BILLION IN THE NEXT HALF-CENTURY (WITH AFRICA AND ASIA DWARFING EUROPE)

       TODAY, THERE ARE 6.1 BILLION PEOPLE IN THE WORLD. BY 2050, THE FIGURE IS ANTICIPATED TO SWELL TO 9.3 BILLION (WITH NEARLY NINE OF EVERY 10 PEOPLE LIVING IN A DEVELOPING COUNTRY.

       CANADA HAS THE SECOND LARGEST LAND MASS IN THE WORLD. THEY ARE COMING HERE!!!!
