The paper presents the results of an empirical study of decisions by the Immigration Appeal Division on "humanitarian and compassionate" appeals from removal orders for serious criminality. In addition to setting out certain key patterns in the decisions, the paper seeks to develop a preliminary theory explaining those patterns. The paper is part of a larger project that seeks to reconsider the role of humanitarian and discretion in Canadian immigration and refugee law.\nColin Grey is associate professor at Queen’s University Faculty of Law. He is the author of Justice and Authority in Immigration Law (Hart, 2015). His most recent project (funded by SSHRC) examines the application of humanitarian and compassionate relief powers in the context of deportation.\nAlyssa Leblond is a PhD in sociology at Queen’s University. Her most recent article, appearing in Critical Criminology, examines how community housing is increasingly seen as a tool of social control and an exclusionary tactic.\n
