Microsoft objected to this and filed <a href=\"http:\/\/ttabvue.uspto.gov\/ttabvue\/v?pno=91195582&amp;pty=OPP&amp;eno=5\">a motion<\/a> challenging this application on January 10<sup>th<\/sup>, 2011. The <a href=\"http:\/\/tarr.uspto.gov\/tarr?regser=serial&amp;entry=77525433&amp;action=Request+Status\">current status<\/a> for Apple\u2019s trademark request is shown on the USPTO website as:\u00a0\u201cAn opposition is now pending at the Trademark Trial and Appeal Board.\u201d In the UK, \u201cApp Store\u201d\u00a0has been\u00a0<a href=\"http:\/\/www.ipo.gov.uk\/ohim?ohimnum=E7078314\">registered as a trademark<\/a> since June 2009.<\/p>\n<p><!--more-->Apple's trademark application for\u00a0<a href=\"http:\/\/tarr.uspto.gov\/tarr?regser=serial&amp;entry=77525433&amp;action=Request+Status\">goods and services<\/a> includes \u201cretail store services featuring computer software provided via the internet and other computer and electronic communication networks\u201d and other related offerings. The App Store is available on electronic devices including the\u00a0iPhone, iPod Touch and iPad, and is now offering more than <a href=\"http:\/\/www.apple.com\/iphone\/apps-for-iphone\/\">300,000 apps<\/a>. Microsoft\u2019s application retail store, known as <a href=\"http:\/\/www.microsoft.com\/windowsphone\/en-us\/apps\/default.aspx\">Marketplace<\/a>, is languishing at <a href=\"http:\/\/www.unwiredview.com\/2011\/01\/12\/windows-phone-7-marketplace-now-offering-6000-apps\/\">6,000 apps<\/a>.<\/p>\n<p>In the motion, Microsoft <a href=\"http:\/\/ttabvue.uspto.gov\/ttabvue\/v?pno=91195582&amp;pty=OPP&amp;eno=5\">argues<\/a> that the term \u201capp\u201d is a generic name for software applications, while \u201cstore\u201d is generic for retail store services. Furthermore, Microsoft states that \u201capp store\u201d is widely used as the name for online stores featuring apps, thus granting this trademark \u00a0would mean that other companies are prevented from referring to their application retail stores as \u201capp stores\u201d. Just as \u201cthe Computer Store\u201d is generic for stores selling computers, \u201cApp Store\u201d is generic for stores selling apps.<\/p>\n<p>Considering that <a href=\"http:\/\/www.google.com\/apps\/\">Google<\/a>, <a href=\"http:\/\/appworld.blackberry.com\/webstore\/\">Blackberry<\/a>, and even the <a href=\"http:\/\/apps.usa.gov\/\">US Government<\/a> are describing their software applications as apps, it seems clear that \u201capp\u201d has now become a generic term.\u00a0At the time of this writing, the majority of voters\u00a0at the WSJ Digits\u00a0online poll\u00a0also appear\u00a0to agree with Microsoft\u2019s position.
