Freedom of Speech: An Ongoing Battle in the UK"},"content":{"rendered":"<p><em>Leslie Chong is a JD candidate at Osgoode Hall Law School.<\/em><\/p>\n<p>Lord Neuberger, the Master of the Rolls, recently <a href=\"https:\/\/inforrm.wordpress.com\/2011\/03\/20\/news-master-of-the-rolls-on-superinjunctions-charlotte-harris\/\" target=\"_blank\" rel=\"noopener noreferrer\">gave a speech<\/a> to the Judicial Studies Board Annual Lecture entitled \u201c<a href=\"http:\/\/www.judiciary.gov.uk\/Resources\/JCO\/Documents\/Speeches\/mr-speech-jsb-lecture-march-2011.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Open Justice Unbound?<\/a>\u201d where he addressed current judicial developments in the UK dealing with open justice and freedom of speech, in particular, the rise in orders granting 'super-injunctions'.<\/p>\n<p><!--more-->Lord Neuberger\u2019s speech reiterated the importance of a continued commitment to open courts as a way of achieving public confidence in our legal system, and how the increased use of \u2018super-injunctions\u2019 threatens these fundamental principles of justice. This concern holds especially true as UK courts seem to be <a href=\"http:\/\/www.guardian.co.uk\/law\/2011\/mar\/29\/superinjunction-financier-libel-legal-case\" target=\"_blank\" rel=\"noopener noreferrer\">expanding the scope<\/a> of those cases that are now being granted super-injunctions \u2013 injunctions that were once used sparsely and only in limited contexts (we think).<\/p>\n<p>\u2018<a href=\"http:\/\/onlinejournalismblog.com\/2009\/10\/15\/super-injunctions-explained\/\" target=\"_blank\" rel=\"noopener noreferrer\">Super-injunctions<\/a>\u2019 prevent journalists from reporting about the mere existence of a case before the courts \u2013 this includes a \u201crestraint from publication of details of the injunction proceeds, application, hearing, proceedings or order\u201d and effectively turns the entire process into a highly secretive procedure. They serve to inhibit freedom of speech by preventing the publication of matters relating to the case before the courts as well as any details about the injunction sought by the parties. The purpose is to prevent a form of 'jigsaw identification' of the parties by issuing an<a href=\"http:\/\/www.bailii.org\/ew\/cases\/EWHC\/QB\/2011\/1059.html\" target=\"_blank\" rel=\"noopener noreferrer\"> injunction 'contra mundum'<\/a> (or 'against the world'). The effect is such that journalists are unable to directly or indirectly refer to details pertaining the case before the courts, or the injunction being sought by the parties.<\/p>\n<p>While UK journalists have seemingly grown accustomed to these prohibitions (some having found <a href=\"..\/..\/..\/..\/..\/2009\/10\/did-barbara-streisand-and-twitter-beat-the-super-injunction\/\" target=\"_blank\" rel=\"noopener noreferrer\">creative ways<\/a> to operate around these gag-orders), their existence brings to light concerns about the limits they create on freedom of speech and the right for the public to scrutinize judicial decision-making. As Lord Neuberger argued, \u201cOpen justice must however yield no more than strictly necessary to secure the achievement of the property administration of justice.\u201d However it remains to be seen whether UK courts will continue expanding the cases to which super-injunctions will be granted, and at what point the courts will find that these \u2018gag-orders\u2019 have begun to unnecessarily trample on the fundamental right of free speech. This concern is exacerbated by the discovery of a <em>new<\/em> form of '<a href=\"http:\/\/www.guardian.co.uk\/law\/2011\/mar\/21\/secrets-to-keep-hyper-injunction\" target=\"_blank\" rel=\"noopener noreferrer\">hyper-injunction<\/a>' which \"specifically bars a person from discussing something with members of Parliament, journalists and lawyers, except for his own defence lawyers.\"<\/p>\n<p>These 'hyper-injunctions' are clearly effective \u2013 we are only just learning about these 2006 court proceedings and only because an MP has chosen to oust the courts with the use of his <a href=\"http:\/\/www.guardian.co.uk\/business\/2011\/mar\/10\/fred-goodwin-superinjunction-banking\" target=\"_blank\" rel=\"noopener noreferrer\">Parliamentary privilege<\/a>. And while these draconian injunctions threaten to undermine the fundamental principles of justice and free speech, their increased used and expanding scope seem to indicate that these draconian 'gag-orders' are likely going nowhere fast. As it stands, the list of cases that have been granted these injunctions include a <a href=\"http:\/\/www.telegraph.co.uk\/news\/uknews\/law-and-order\/8028739\/Public-figure-joins-footballers-in-getting-super-injunction-over-sex-life.html\" target=\"_blank\" rel=\"noopener noreferrer\">professional football player\u2019s personal life<\/a>, an <a href=\"http:\/\/www.guardian.co.uk\/media\/2009\/oct\/13\/guardian-gagged-parliamentary-question\" target=\"_blank\" rel=\"noopener noreferrer\">oil company and their toxic waste cover-up<\/a>, and now in an ex-financier\u2019s libel case.\u00a0 So how far is too far, and at what point has free speech has been frivolously compromised by these \u2018super-injunctions\u2019? And while these super-injunctions continue to be been used (the frequency of which is subject to pure conjecture and speculation) in the UK, practitioners and academics <a href=\"http:\/\/www.lawyersweekly.ca\/index.php?section=article&amp;articleid=1129\" target=\"_blank\" rel=\"noopener noreferrer\">have suggested<\/a> that they have never really gained popularity in Canada, although \u201cthey could be granted routinely without most of us being any wiser.\u201d Here\u2019s hoping that they stay across the pond.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Leslie Chong is a JD candidate at Osgoode Hall Law School.
