{"id":16587,"date":"2012-05-22T18:51:18","date_gmt":"2012-05-22T22:51:18","guid":{"rendered":"http:\/\/www.iposgoode.ca\/?p=16587"},"modified":"2012-05-22T18:51:18","modified_gmt":"2012-05-22T22:51:18","slug":"stealth-bombers-back-on-the-radar-the-anton-piller-order","status":"publish","type":"post","link":"https:\/\/www.yorku.ca\/osgoode\/iposgoode\/2012\/05\/22\/stealth-bombers-back-on-the-radar-the-anton-piller-order\/","title":{"rendered":"Stealth Bombers Back on the Radar \u2013 The Anton Piller Order"},"content":{"rendered":"<p>As the author of the highly publicized decisions of <em><a href=\"http:\/\/www.iposgoode.ca\/2012\/02\/kerwhizz-v-the-bounch-bunch-the-ongoing-confusion-with-subconscious-copying\/\">Kerwhizz<\/a><\/em> and <em><a href=\"http:\/\/www.bailii.org\/ew\/cases\/EWPCC\/2012\/1.html\">Temple Island Collections<\/a><\/em>, Judge Birss of the England and Wales <a href=\"http:\/\/www.justice.gov.uk\/downloads\/courts\/patents-court\/patents-court-guide.pdf\/\">Patent County Court (PCC)<\/a> is no stranger to controversy. In his latest judgment, <em><a href=\"http:\/\/www.bailii.org\/ew\/cases\/EWPCC\/2012\/20.html\">Suh v Ryu<\/a><\/em>, Birss J appeared to settle a relatively straightforward procedural matter. Closer scrutiny reveals that his reasons are reflective of an ongoing policy debate in Canada and abroad \u2013 the use of the <em>Anton Piller<\/em> injunction in intellectual property disputes.<\/p>\n<p><!--more--><\/p>\n<p>The <em>Anton Piller <\/em>takes its name from a 1975 <a href=\"http:\/\/www.bailii.org\/ew\/cases\/EWCA\/Civ\/1975\/12.html\">case<\/a> of the English Chancery Division. A plaintiff applies on an <em>ex parte <\/em>basis for an order to search the premises (and sometimes private homes) of a defendant with the purpose of preserving evidence that might otherwise be destroyed or concealed if notice was to be provided. It is especially useful (likely required) in modern <a href=\"http:\/\/degrandpre.com\/documents\/publications\/Art-EL-200501-A.pdf\">IP<\/a> disputes where incriminating computer data can be quickly erased. They are also important in the fight against counterfeit <a href=\"http:\/\/decisions.fct-cf.gc.ca\/en\/1999\/t-2027-97_15371\/t-2027-97.html\">designs<\/a> and <a href=\"http:\/\/www.canlii.org\/eliisa\/highlight.do?text=celanese+v+murray&amp;language=en&amp;searchTitle=Search+all+CanLII+Databases&amp;path=\/en\/on\/onsc\/doc\/2010\/2010canlii29089\/2010canlii29089.html\">industrial espionage<\/a>.<\/p>\n<p>At issue in <em>Suh v Ryu <\/em>was whether the PCC had jurisdiction to grant <em>Anton Piller or Mareva <\/em>(asset-freezing)<em> <\/em>injunctions. The PCC is a unique county court whose jurisdiction was <a href=\"http:\/\/www.justice.gov.uk\/downloads\/courts\/patents-court\/patents-court-guide.pdf\/\">historically<\/a> divided between a \u201cspecial jurisdiction\u201d (patents and designs), and an \u201cordinary jurisdiction\u201d (copyright and trademark). In 1994, Ralph-Gibson LJ of the <a href=\"http:\/\/rpc.oxfordjournals.org\/content\/111\/12\/407.abstract\">Court of Appeal<\/a> reviewed the relevant <a href=\"http:\/\/www.uklaws.org\/statutory\/instruments_06\/doc06931.htm\">Regulation<\/a>, which disempowers county courts from issuing these injunctions, and concluded that the PCC\u2019s jurisdiction to issue <em>Marevas <\/em>or <em>Anton Pillers e<\/em>xtended only to matters falling within its \u201cspecial jurisdiction.\u201d<\/p>\n<p align=\"left\">Birss J declined to follow the precedent and ruled that the PCC could issue these injunctions in matters falling within both its \u201cspecial\u201d and \u201cordinary\u201d jurisdictions. Effectively, he unilaterally expanded his own jurisdiction based on a well-reasoned reassessment of the legislation. However, one question begged to be answered - why did Parliament restrict the ability of some courts to issue <em>Anton Pillers<\/em> and <em>Marevas <\/em>in the first place?<\/p>\n<p align=\"left\">Since its inception <em>Anton Pillers<\/em> were labelled \u201cextraordinary remedies,\u201d requiring the fulfillment of four stringent conditions: (1) the applicant must have an extremely strong <em>prima facie<\/em> case; (2) the potential or actual damage to the applicant must be very serious; (3) the material must be in the possession of the defendant; and (4) there is a real possibility that the defendant would destroy the material if an <em>inter partes<\/em> motion was made.<\/p>\n<p align=\"left\">However, this judicial test has not prevented abuse in Canada or the UK. The highly intrusive nature of the <em>Anton Piller <\/em>coupled with the lack of notice to the defendant has led to it being called the \u201c<a href=\"http:\/\/www.mondaq.com\/canada\/article.asp?articleid=86752\">private search warrant<\/a>\u201d and the \u201c<a href=\"http:\/\/www.mccarthy.ca\/pubs\/Anton_Piller_article_SMason.pdf\">stealth bomber of litigation<\/a>.\u201d <a href=\"http:\/\/www.law-lib.utoronto.ca\/law-review\/abstract\/ultr54_1\/54_1_107.htm\">Godin<\/a> pointed out that plaintiffs often have no intention of using <em>Anton Pillers<\/em> for their supposed purpose of preserving evidence - matters involving <em>Anton Pillers <\/em>rarely proceed to trial. Courts have also grappled with <a href=\"http:\/\/www.lawgazette.co.uk\/news\/columbia-picture-industries-inc-and-others-v-robinson-and-others\">overzealousness<\/a> in the execution of the orders, and <a href=\"http:\/\/canlii.org\/en\/on\/onsc\/doc\/2005\/2005canlii3946\/2005canlii3946.pdf\">insufficient drafting<\/a> by motions judges. Both of which have resulted in aggressive search methods and the wrongful appropriation of documents protected by solicitor-client privilege or even trade secrets.<\/p>\n<p align=\"left\">It is these issues that prompted the UK Parliament to amend its <a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/1997\/12\/section\/7\">rules<\/a> concerning <em>Anton Pillers<\/em>. Presumably, this also explains why Parliament deliberately sought to reserve the power to order <em>Anton Piller <\/em>and <em>Mareva <\/em>injunctions to the more experienced judges of the higher courts.<\/p>\n<p align=\"left\">This observation is pertinent to Canada where what was once described as an \u201cextraordinary remedy\u201d has become <a href=\"http:\/\/www.canada.com\/story_print.html?id=0347d3fa-1868-4ee5-a966-9c64c4faa9ce&amp;sponsor\">standardized<\/a> practice. This is particularly troublesome for three reasons. First, <em>Anton Pillers<\/em> are not subject to <em><a href=\"http:\/\/www.canlii.org\/eliisa\/highlight.do?text=Viacom+Ha%21&amp;language=en&amp;searchTitle=Search+all+CanLII+Databases&amp;path=\/en\/ca\/fct\/doc\/2000\/2000canlii15260\/2000canlii15260.html\">Charter <\/a><\/em><a href=\"http:\/\/www.canlii.org\/eliisa\/highlight.do?text=Viacom+Ha%21&amp;language=en&amp;searchTitle=Search+all+CanLII+Databases&amp;path=\/en\/ca\/fct\/doc\/2000\/2000canlii15260\/2000canlii15260.html\">scrutiny<\/a>. This is so despite that the theoretical distinction between a police search and an <em>Anton Piller<\/em> is tenuous at best, and at least <a href=\"http:\/\/canlii.org\/en\/on\/onsc\/doc\/2005\/2005canlii3946\/2005canlii3946.pdf\">one<\/a> Canadian judge has called a spade a spade - no obvious reason exists to explain why basic rights are somehow weakened in civil, rather than criminal or administrative matters.<\/p>\n<p align=\"left\">Second, the Federal Court\u2019s invention of the \u201crolling <em>Anton Piller<\/em>\u201d is more problematic. Here, the plaintiff is permitted to execute search and seizures on a class of John and Jane Does, and attach the individual defendants as they become identified. It is typically sought against those with transient business practices such as street vendors who deal in <a href=\"http:\/\/decisions.fct-cf.gc.ca\/en\/1999\/t-2027-97_15371\/t-2027-97.html\">counterfeit goods<\/a>. Although no realistic alternative exists, the potential for misuse is higher when such orders are based on undue speculation, which<em> <\/em>Hughes J recently commented on in <em><a href=\"http:\/\/decisions.fct-cf.gc.ca\/en\/2010\/2010fc387\/2010fc387.html\">Vinod Chopra.<\/a> <\/em><\/p>\n<p align=\"left\">Third, despite that the Federal Court is by far the largest issuer of <em>Anton Pillers<\/em>, the <a href=\"http:\/\/laws-lois.justice.gc.ca\/eng\/regulations\/SOR-98-106\/page-83.html#h-134\">Rules<\/a> are substantively empty and no model order exists, which increases the likelihood of inadequate drafting by motions judges. In <em><a href=\"http:\/\/scc.lexum.org\/en\/2006\/2006scc36\/2006scc36.html\">Celanese<\/a><\/em>, the Supreme Court of Canada was forced to create its own best practices for <em>Anton Pillers <\/em>to fill this gap.<\/p>\n<p align=\"left\">Returning to Birss J\u2019s judgment - his statutory interpretation is persuasive and seems to properly reflect the role of today\u2019s PCC. However, <em>Anton Pillers<\/em> are invasive remedies with a high potential for abuse, as experience has shown.
