{"id":21570,"date":"2013-07-16T11:28:31","date_gmt":"2013-07-16T15:28:31","guid":{"rendered":"http:\/\/www.iposgoode.ca\/?p=21570"},"modified":"2013-07-16T11:28:31","modified_gmt":"2013-07-16T15:28:31","slug":"cbcs-ici-rebranding-turns-from-pr-debacle-to-legal-one","status":"publish","type":"post","link":"https:\/\/www.yorku.ca\/osgoode\/iposgoode\/2013\/07\/16\/cbcs-ici-rebranding-turns-from-pr-debacle-to-legal-one\/","title":{"rendered":"CBC\u2019s \u201cIci\u201d Rebranding Turns From PR Debacle to Legal One"},"content":{"rendered":"<p>CBC\u2019s ill-fated \u201cIci\u201d re-branding may be getting clawed back, but that\u2019s not stopping Radio-Canada from seeking <a href=\"http:\/\/cas-ncr-nter03.cas-satj.gc.ca\/IndexingQueries\/infp_RE_info_e.php?court_no=T-513-13\" target=\"_blank\" rel=\"noopener noreferrer\">a trade-mark expungement<\/a> against current broadcaster and \u201cIci\u201d trade-mark holder, Sam Nozouri.<!--more--><br class=\"none\" \/><br class=\"none\" \/><\/p>\n<p><b>Background<br \/>\n<\/b>CBC\u2019s French division Radio-Canada rolled out its \u201cIci\u201d branding to <a href=\"http:\/\/www.timescolonist.com\/entertainment\/radio-canada-addresses-backlash-over-brand-change-1.314465\" target=\"_blank\" rel=\"noopener noreferrer\">much criticism<\/a>, ranging from mocking to anger, because the re-marketing downplayed Radio-Canada\u2019s main name and state broadcaster status. In fact, the new brand largely eradicated the Radio-Canada affiliation.<br class=\"none\" \/><br class=\"none\" \/><\/p>\n<p>Radio-Canada quickly <a href=\"http:\/\/www.torontosun.com\/2013\/06\/11\/cbc-ici-rebranding-retreat-satisfies-moore\" target=\"_blank\" rel=\"noopener noreferrer\">backtracked on the brand update, much to the satisfaction<\/a> of Heritage Minister James Moore, whose portfolio responsibility includes Radio-Canada. The new, new brand will clearly include both \u201cIci\u201d and \u201cRadio-Canada\u201d.<\/p>\n<blockquote><p>\"They made the right decision in going back,\" Moore told news outlets after the announcement. \"Maintaining a clearly Canadian brand for Canada's broadcaster is the right choice.\"<br class=\"none\" \/><br class=\"none\" \/><\/p><\/blockquote>\n<p>The marketing misstep even made it <a href=\"http:\/\/www.nytimes.com\/2013\/06\/11\/business\/media\/quick-reversal-for-plan-to-rename-canadian-broadcaster.html?_r=0\" target=\"_blank\" rel=\"noopener noreferrer\">into the New York Times<\/a>.<br class=\"none\" \/><br class=\"none\" \/><\/p>\n<p><b>Legal implications<br \/>\n<\/b>But there\u2019s a second legal layer to the problematic re-branding. Montreal broadcaster Sam Norouzi obtained a licence from the <a href=\"http:\/\/www.crtc.gc.ca\/eng\/home-accueil.htm\" target=\"_blank\" rel=\"noopener noreferrer\">Canadian Radio-television and Telecommunications Commission<\/a> (CRTC) for the multi-language channel \u201cICI \u2013 International Channel\/Canal international\u201d <a href=\"http:\/\/blogues.journaldemontreal.com\/liseravary\/actualites\/limmediatete-et-la-febrilite-debarquent-ici\/\" target=\"_blank\" rel=\"noopener noreferrer\">in 2011<\/a>. Similarly, Norouzi legally registered the trade-mark \u201cIci\u201d with the <a href=\"http:\/\/www.cipo.ic.gc.ca\/eic\/site\/cipointernet-internetopic.nsf\/eng\/Home\" target=\"_blank\" rel=\"noopener noreferrer\">Canadian Intellectual Property Office<\/a> (CIPO) and received an official CIPO trade-mark certificate in <a href=\"http:\/\/www.lapresse.ca\/arts\/television\/201306\/13\/01-4660798-poursuivi-par-radio-canada-parce-quil-veut-appeler-sa-chaine-ici.php\" target=\"_blank\" rel=\"noopener noreferrer\">September 2012<\/a>. Norouzi originally planned to to launch his channel this coming fall.<br class=\"none\" \/><br class=\"none\" \/><\/p>\n<p>But there are holes in Norouzi\u2019s legal argument, as <a href=\"http:\/\/www.montrealgazette.com\/entertainment\/Radio+Canada+rebranding+spells+trouble+businessman\/8506057\/story.html\" target=\"_blank\" rel=\"noopener noreferrer\">trade-mark lawyer Pascal Lauzon told<\/a> the Montreal Gazette. Firstly, a trade-mark <a href=\"http:\/\/laws-lois.justice.gc.ca\/eng\/acts\/T-13\/page-20.html?texthighlight=unregistered#s-48.\" target=\"_blank\" rel=\"noopener noreferrer\">doesn\u2019t need to be registered to be recognized<\/a> in Canadian law. Secondly, a trade-mark may be expunged through sections <a href=\"http:\/\/www.cipo.ic.gc.ca\/eic\/site\/cipointernet-internetopic.nsf\/eng\/h_wr01843.html\" target=\"_blank\" rel=\"noopener noreferrer\">45<\/a> and <a href=\"http:\/\/laws-lois.justice.gc.ca\/eng\/acts\/T-13\/page-24.html#docCont\" target=\"_blank\" rel=\"noopener noreferrer\">56<\/a> of the <a href=\"http:\/\/laws-lois.justice.gc.ca\/eng\/acts\/T-13\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Trade-marks Act<\/em><\/a> up to five years after CIPO registration. Thirdly, a paperwork technicality \u2013 wherein Norouzi informed CIPO in August 2012 that he had already started using the name when in fact the station had not yet launched \u2013 may also leave him legally vulnerable.<\/p>\n<blockquote><p>\u201cIf you file a faulty or untrue declaration of use, it can invalidate the entire registration,\u201d Lauzon told the Gazette. \u201cIf he had waited, he would be in a much better position.\u201d<br class=\"none\" \/><br class=\"none\" \/><\/p><\/blockquote>\n<p>Spokesperson Marc Pichette states Radio-Canada has a history of \u201cIci\u201d use akin to an unregistered trade-mark dating back to the 1930s. The broadcaster\u2019s official internal magazine was called \u201cIci Radio Canada\u201d from 1966 to 1985 and Radio-Canada registered a semi-similar \u201c\u00c9ditions Ici Radio-Canada\u201d trade-mark in 1969 for a failed publishing wing.<\/p>\n<blockquote><p>\u201cIt is more or less universally known in the French market and has, in fact, become almost as iconic an identifier as Radio-Canada itself,\u201d <a href=\"http:\/\/news.nationalpost.com\/2013\/06\/07\/radio-canada-sues-new-tv-station-that-owns-trade-mark-to-the-word-ici\/\" target=\"_blank\" rel=\"noopener noreferrer\">Pichette told the National Post<\/a>.<br class=\"none\" \/><br class=\"none\" \/><\/p><\/blockquote>\n<p>Radio-Canada has not requested an injunction, but has requested that Norouzi stop using \u201cIci\u201d and destroy all materials with the name, or else pay damages \u201c<a href=\"http:\/\/lesnews.ca\/business\/45328-ici-au-coeur-dune-bataille-juridique\/\" target=\"_blank\" rel=\"noopener noreferrer\">which may exceed $50,000<\/a>.\u201d No court date has been set.<br class=\"none\" \/><br class=\"none\" \/><\/p>\n<p><b>Analysis and opinion<br \/>\n<\/b>It sounds like Radio-Canada has a decent case when you combine the historical use of \u201cIci\u201d with the yet-unmet statute of limitations for federal trade-mark expungement.<br class=\"none\" \/><br class=\"none\" \/><\/p>\n<p>That said, it is my opinion that Radio-Canada is still making a mistake.<br class=\"none\" \/><br class=\"none\" \/><\/p>\n<p>As I\u2019ve argued <a href=\"http:\/\/www.canadianbusiness.com\/blogs-and-comment\/social-media-strategies-in-the-age-of-knee-jerk\/\" target=\"_blank\" rel=\"noopener noreferrer\">before<\/a>, sometimes exercising a legal right doesn\u2019t translate well into the court of public opinion. And the court of public opinion is an arena that Radio-Canada cannot ignore, especially on the heels of the re-branding outcry.<br class=\"none\" \/><br class=\"none\" \/><\/p>\n<p>Canadians, the Minister of Heritage, and the broadcaster itself have loudly declared that \u201cRadio-Canada\u201d is the brand, which would make \u201cIci\u201d more a slogan than anything else. Considering this, I propose that there is more than enough room in the Quebec market for a Radio-Canada broadcaster with an \u201cIci\u201d slogan and an ICI broadcaster with or without any additional slogans. <br class=\"none\" \/><br class=\"none\" \/><\/p>\n<p>This is particularly true when you consider market segmentation. ICI, the broadcaster, intends to focus on \"allophone\" content\u00a0\u2013 primarily non-English, non-French programming in more than a dozen different languages. This is a market entirely discrete from Radio-Canada\u2019s content, which is exclusively French.<br class=\"none\" \/><br class=\"none\" \/><\/p>\n<p>At its root, a trade-mark is a tool that provides legal rights to the holder against others who seek to diminish the value of the brand trade-marked by passing themselves off as a similar or related entity.<br class=\"none\" \/><br class=\"none\" \/><\/p>\n<p>I don\u2019t believe the \u201cIci\u201d slogan is closely affiliated enough with the Radio-Canada brand to warrant copycats. Radio-Canada\u2019s use of \u201cIci\u201d has been inconsistent, as indicated by Pichette\u2019s dated references. I lived in Quebec for five years and have consumed much Radio-Canada content throughout my life. At no point did I feel \u201cIci\u201d was a core part of the branding.<br class=\"none\" \/><br class=\"none\" \/><\/p>\n<p>And I don\u2019t believe ICI is attempting to be a copycat. ICI stands as an acronym for a full channel name that embodies its unique multi-language offering; this is indicative of a good faith trade-mark registration.<br class=\"none\" \/><br class=\"none\" \/><\/p>\n<p>Radio-Canada may win their expungement case, but not without accumulating industry enemies and negative public sentiment during an already tumultuous time. Ici Radio-Canada T\u00e9l\u00e9 and ICI \u2013 International Channel\/Canal international can live in harmony.
