{"id":35653,"date":"2020-06-30T11:37:10","date_gmt":"2020-06-30T15:37:10","guid":{"rendered":"https:\/\/www.iposgoode.ca\/?p=35653"},"modified":"2020-06-30T11:37:10","modified_gmt":"2020-06-30T15:37:10","slug":"wiseau-studio-llc-v-harper-good-news-for-canadian-filmmakers-on-fair-dealing-and-documentaries","status":"publish","type":"post","link":"https:\/\/www.yorku.ca\/osgoode\/iposgoode\/2020\/06\/30\/wiseau-studio-llc-v-harper-good-news-for-canadian-filmmakers-on-fair-dealing-and-documentaries\/","title":{"rendered":"Wiseau Studio, LLC v Harper: Good News for Canadian Filmmakers on Fair Dealing and Documentaries"},"content":{"rendered":"\n<p>Justice Paul Schabas has provided artists in Canada with the most authoritative statement yet on the bounds of fair dealing as it applies to documentary films in releasing his decision in the case of <a href=\"https:\/\/www.canlii.org\/en\/on\/onsc\/doc\/2020\/2020onsc2504\/2020onsc2504.html?searchUrlHash=AAAAAQAPd2lzZWF1IHYgaGFycGVyAAAAAAE&amp;resultIndex=1\"><em>Wiseau Studio, LLC v Harper<\/em><\/a> on April 23, 2020.<\/p>\n<p>The journey to Justice Schabas\u2019 2020 decision begins back in 2003, when the plaintiff Tommy Wiseau released <em>The Room<\/em>, widely acknowledged as one of the <a href=\"https:\/\/www.bbc.com\/culture\/article\/20160212-the-room-why-so-many-love-the-worst-film-ever-made\">worst movies of all time<\/a>. The film\u2019s unwatchability (it has been described as a \u201c<a href=\"https:\/\/www.bbc.com\/culture\/article\/20160212-the-room-why-so-many-love-the-worst-film-ever-made\">car crash of incompetence and catastrophic misjudgment<\/a>\u201d that is \u201c<a href=\"https:\/\/www.independent.co.uk\/arts-entertainment\/art\/features\/terrible-acting-flimsy-sets-wanton-misogynytommy-wiseaus-the-room-becomes-a-cult-hit-8515346.html\">rife with flimsy sets, terrible acting and wanton misogyny<\/a>\u201d), along with the mystery surrounding its creator, helped the Room to develop a cult fan base. The film has <a href=\"https:\/\/www.newyorker.com\/culture\/richard-brody\/why-the-room-is-a-better-movie-than-james-francos-the-disaster-artist\">continued to screen regularly since its 2003 release so that audiences might mock it<\/a>, and has lent inspiration to James Franco\u2019s 2017 Hollywood release, <em>The Disaster Artist<\/em>, as well as a lesser-known documentary about <em>The Room<\/em> created by the Defendants and titled <em>Room Full of Spoons<\/em>.<\/p>\n<p>In 2011, the defendants began work on their documentary titled <em>Room Full of Spoons<\/em>, with the project initially welcomed by Wiseau. As his support for the film waned, the defendants, who were already in the production process, proceeded with their plans for filming. What followed for the defendants were years of legal threats and egregious behaviour by the plaintiffs, and an eventual wrongful injunction preventing the release of their film, all of which is outlined in Justice Schabas\u2019 decision and in his discussion of freedom of expression in Canada.<\/p>\n<p>For documentarians in Canada, <em>Wiseau Studio, LLC v Harper<\/em> has changed the game. Previously relying on interpretations of the <em><a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-42\/index.html\">Copyright Act<\/a><\/em> and advice such as that contained in <a href=\"http:\/\/www.moffatco.com\/pages\/publications\/HPK_white_paper.pdf\"><em>The White Paper<\/em><\/a>, <em>Wiseau Studio, LLC v Harper<\/em> provides Canadian filmmakers with an authoritative statement defining documentaries as an allowable purpose under <a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-42\/page-9.html#h-103270\">the<em> Copyright Act\u2019s<\/em> Fair Dealing provisions<\/a>. In his reasons, Justice Schabas tells us that \u00a0\u201c<a href=\"https:\/\/www.canlii.org\/en\/on\/onsc\/doc\/2020\/2020onsc2504\/2020onsc2504.html?searchUrlHash=AAAAAQAPd2lzZWF1IHYgaGFycGVyAAAAAAE&amp;resultIndex=1\">to the extent that a documentary uses copyrighted material for the purposes of criticism, review or news reporting, then such use is for an allowable purpose under the fair dealing provisions of the Copyright Act<\/a>\u201d.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/p>\n<p>Further rounding out this proclamation is the statement that many practices standard to documentary filmmaking can in themselves satisfy the second part of the fair dealing test regarding fair use. In looking at the purpose and character of the dealing, Justice Schabas points out that documentaries are rarely produced with the expectation of commercial profit, and that it is a common technique of documentary filmmaking to provide narration over the copyrighted work that is used, finding the use of clips from a copyrighted work for the purpose of commentary to be an example of fair dealing.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> Regarding alternatives to the dealing, Justice Schabas notes that in a case such as this, when the documentary is about the copyright-protected work itself, there is \u201c<a href=\"https:\/\/www.canlii.org\/en\/on\/onsc\/doc\/2020\/2020onsc2504\/2020onsc2504.html?searchUrlHash=AAAAAQAPd2lzZWF1IHYgaGFycGVyAAAAAAE&amp;resultIndex=1\">no alternative to the copyrighted material to make the points that are made<\/a>\u201d.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/p>\n<p>Justice Schabas\u2019 decision drives home the notion that a core purpose of Canadian copyright law is to balance the rights of users with those of owners, and affirms fair dealing as a user\u2019s right as opposed to a defence to copyright infringement. Justice Schabas points out that Fair Dealing exists as an important part of copyright law as it works to ensure that creators of critical works of public interest won\u2019t be silenced by copyright owners whose original work they wish to critique, stating that Fair Dealing \u201c<a href=\"https:\/\/www.canlii.org\/en\/on\/onsc\/doc\/2020\/2020onsc2504\/2020onsc2504.html?searchUrlHash=AAAAAQAPd2lzZWF1IHYgaGFycGVyAAAAAAE&amp;resultIndex=1\">is based on a range of factors that respect the rights of speakers and users to communicate information and views to the public without undue restrictions<\/a>\u201d.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/p>\n<p>The decision provides other practical guidance for documentarians in Canada, confirming that providing credit in the end roll will satisfy the attribution requirement for fair dealing<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a>, and providing insight into substantial takings (any justified taking must be <em>very<\/em> insubstantial).<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> The decision also provides guidance on technological protection measures, otherwise known as digital locks (<a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-42\/page-19.html#h-104106\">s. 41.1(1) Copyright Act<\/a>), providing that any claim brought regarding digital locks must have an evidentiary basis.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a><\/p>\n<p>Beyond its colourful and at times incredibly frustrating facts, <em>Wiseau Studio, LLC v Harper<\/em> provides members of the Canadian arts community, and documentarians in particular, with a wealth of practical and authoritative guidance on Fair Dealing as a user\u2019s right. Schabas\u2019 decision is a strong statement on the importance of works that report and criticize, and on freedom of expression in Canada.<\/p>\n<p><em>Written by Meghan Carlin.
