Members of fandoms often participate in various creative activities inspired by their source material, including dressing up as the characters, writing stories based in the fictional universe, and making drawings about the original work.<\/p>\n<p>While most creators support fandoms, with some even <a href=\"https:\/\/fanexpohq.com\/comicontoronto\/celebrities\/\">regularly appearing at fan conventions<\/a>, the line between appreciating a creator\u2019s work and copying can be blurred. What may seem like a harmless activity in the spirit of fandom can at times give rise to copyright infringement.\u00a0<\/p>\n<p><strong>Cosplay<\/strong><\/p>\n<p><a href=\"https:\/\/www.who.com.au\/what-is-cosplay\">Cosplay<\/a> (or \u201ccostume play\u201d) is the act of dressing up as a character, often from anime, video games, comics, television, or film. Though the term dates back to the 1980s, the practice has existed for centuries. It is often associated with <a href=\"https:\/\/animecons.com\/events\/map\/\">comic or pop culture conventions<\/a>, where fans attend in the masses, taking on characters from popular franchises such as <em>Doctor Who<\/em>, <em>Star Wars<\/em>, and Marvel movies to the animated universes of <em>Pok\u00e9mon<\/em>, <em>Naruto<\/em>, <em>Final Fantasy,<\/em> and beyond.\u00a0<\/p>\n<p>This year, Japan made <a href=\"https:\/\/kotaku.com\/the-japanese-government-could-change-cosplay-forever-1846123799\">headlines<\/a> by proposing a new law that could potentially create copyright infringement problems for cosplayers. In Japan, cosplay can be a fruitful endeavour, with successful professional cosplayers earning upwards of $90,000 a month from public appearances, merchandise, photo books, and more. Japan\u2019s proposed new law would require professional cosplayers to pay a fee to the creators of the characters they cosplay in specific circumstances (<a href=\"https:\/\/www.cosplaycentral.com\/topics\/cosplay\/news\/new-cosplay-copyright-law-in-japan-clarified-by-government\">for example<\/a>, when appearing as a character for an event or on television).<\/p>\n<p>Luckily for most cosplayers, their costumes likely do not infringe copyright laws. In both the <a href=\"https:\/\/www.copyright.gov\/register\/va-useful.html#:~:text=A%20%E2%80%9Cuseful%20article%E2%80%9D%20is%20an,%2C%20dinnerware%2C%20and%20lighting%20fixtures.\">United States<\/a> and <a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-42\/page-17.html#h-104774\">Canada<\/a>, <a href=\"https:\/\/www.iposgoode.ca\/2021\/10\/the-hocus-pocus-of-intellectual-property-in-halloween-costumes\/\">costumes do not fall under copyright protection<\/a> given their classification as \u201cuseful articles.\u201d Although there are complexities\u2014for example, <a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-42\/section-64.html\">exceptions preventing the reproduction of trademarks on useful articles<\/a> and <a href=\"https:\/\/www.iposgoode.ca\/2021\/10\/the-hocus-pocus-of-intellectual-property-in-halloween-costumes\/\">masks and jewelry potentially being subject to copyright<\/a>\u2014replicating costumes, for the most part, is a liability-free activity. Even if copyright subsists in some features of the costume, reproducing these elements for personal, non-commercial purposes is permissible in both <a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-42\/page-8.html#h-103270\">Canada<\/a> and the <a href=\"https:\/\/repository.law.umich.edu\/cgi\/viewcontent.cgi?article=1218&amp;context=articles\">United States<\/a>.<\/p>\n<p><strong>Fanfiction and Fanart <\/strong><\/p>\n<p>Fanfiction and fanart are other popular forms of fan expression. As the name suggests, fanfiction and fanart are content by fans based on existing works of fiction.<\/p>\n<p>Though fanfiction and fanart have arguably been around as long as fiction, with authors and artists drawing inspiration from one another, the <a href=\"https:\/\/www.techtimes.com\/articles\/70108\/20150723\/fan-fiction-star-trek-harry-potter-history-of-fan-fiction-shakespeare-roman-mythology-greek-mythology-sherlock-holmes.htm\">modern conception<\/a> of the activities as expressions of fandom arose in the 1960s via Trekkies (fans of <em>Star Trek<\/em>).<\/p>\n<p>Unfortunately, laws around fanfiction and fanart are not clear. In the United States, copyright holders have the sole right to <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/17\/106\">prepare derivative works<\/a>, including major copyrightable elements of an original, previously created work. <a href=\"https:\/\/digitalcommons.osgoode.yorku.ca\/cgi\/viewcontent.cgi?referer=&amp;httpsredir=1&amp;article=1990&amp;context=ohlj\">Canada<\/a> lacks an analogous provision but does have other provisions under <a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-42\/section-3.html\">section 3(1) of the <\/a><a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-42\/section-3.html\"><em>Copyright<\/em><\/a> <a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-42\/section-3.html\"><em>Act<\/em><\/a> that offers rights holders similar protection, such as the sole right to publish any translation of the work or convert the work into other forms. However, users\u2019 rights provisions (<a href=\"https:\/\/www.copyright.gov\/fair-use\/index.html\">fair use<\/a> in the United States and <a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-42\/page-6.html#docCont\">fair dealing<\/a> in Canada) may provide a legal basis for fan creations to exist. A fairness assessment may consider relevant factors like commercialization, amount and substantiality of the copied work, and how \u201ctransformative\u201d the fan-made work is. Fans may not even have to avail to fairness assessments by arguing that their fan creations are sufficiently original. As it is well-established that authors do not have copyright protection in facts and ideas, including <a href=\"https:\/\/www.iposgoode.ca\/2021\/07\/historical-fake-news-winkler-v-hendley\/\">fictional or creative facts<\/a>, fans may argue that their works contain only the underlying, non-copyrightable elements from the source material.<\/p>\n<p>While the law surrounding fanfiction and fanart is still grey, authors\u2019 views on the subject are divided. Some authors, most notably the late <a href=\"https:\/\/fanlore.org\/wiki\/Where_has_Anne_Rice_fanfiction_gone\">Anne Rice<\/a> and <a href=\"https:\/\/web.archive.org\/web\/20130613053918\/http:\/grrm.livejournal.com\/151914.html\">George R. R. Martin<\/a>, strongly oppose fanfiction, believing it to be copyright infringement. The majority, however, see fan-made content as a form of <a href=\"https:\/\/digitalcommons.wcl.american.edu\/cgi\/viewcontent.cgi?article=1112&amp;context=ipbrief\">flattery<\/a>, and essentially, free advertising for the original work. The author of the famed <em>Twilight <\/em>series, Stephenie Meyer, was known for <a href=\"https:\/\/web.archive.org\/web\/20111006021434\/http:\/stepheniemeyer.com\/ts_fansites.html\">publishing links to fansites<\/a> and <a href=\"https:\/\/www.cheatsheet.com\/entertainment\/stephenie-meyer-appreciates-fanfiction-but-urges-writers-to-go-do-something-you-can-claim-too.html\/\">supported <\/a><a href=\"https:\/\/www.cheatsheet.com\/entertainment\/stephenie-meyer-appreciates-fanfiction-but-urges-writers-to-go-do-something-you-can-claim-too.html\/\"><em>Fifty Shades of Grey<\/em><\/a>, which originated as a <em>Twilight <\/em>fanfic.\u00a0<\/p>\n<p>Despite the legal uncertainty, fanfiction and fanart continue to rise. The ubiquity of fanfiction and fanart combined with high litigation costs may deter the small minority of authors and publishers who dislike the practice from launching lawsuits. After all, suing your fans isn\u2019t the best way to earn their
