Still, the <a href=\"https:\/\/www.creativebloq.com\/how-to\/make-and-sell-an-NFT\">straightforward process<\/a> for creating non-fungible tokens (NFT) has accelerated the <a href=\"https:\/\/www.vice.com\/en\/article\/n7vxe7\/people-are-stealing-art-and-turning-it-into-nfts\">theft of digital art<\/a>. Listing someone else\u2019s artwork on an NFT marketplace is as simple as saving a copy of the work from an artist\u2019s website or social media platform and uploading it onto a marketplace where it is minted into an NFT. The rampant theft has forced some artists to <a href=\"https:\/\/twitter.com\/LiamRSharp\/status\/1471940531554959360?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1471940531554959360%7Ctwgr%5E%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fhyperallergic.com%2Fwp-admin%2Fpost.php%3Fpost%3D702309action%3Dedit\">stop sharing their work online<\/a>, limiting the ability of artists to profit from the commercialization of their IP.<\/p>\n<p><strong>What Can Artists Do When Someone Else Mints their Work into an NFT?<\/strong><\/p>\n<p>Copyright law provides recourse to authors who feel their work has been minted into an NFT without permission, but as copyright attorney <a href=\"https:\/\/www.vice.com\/en\/article\/n7vxe7\/people-are-stealing-art-and-turning-it-into-nfts\">Nelson Rosario<\/a> cautions, \u201cIP considerations get very complex very quickly.\u201d The author of a copyright-protected work can bring a claim for copyright infringement, but this is contingent on knowing the infringer\u2019s identity. Many NFT marketplaces do not require the person listing the piece to provide proof of ownership or personal information. Alternatively, authors can inform marketplaces of copyright infringement and request the removal of infringing content. Some marketplaces, like OpenSea, provide artists with a <a href=\"https:\/\/airtable.com\/shrgFP1znwxhxWjrt\">takedown request form<\/a> when they suspect someone is infringing their IP. However, this mechanism places the burden on artists to monitor marketplaces for infringement and is <a href=\"https:\/\/www.nbcnews.com\/tech\/security\/nft-art-sales-are-booming-just-artists-permission-rcna10798\">not sustainable<\/a> given the number of requests OpenSea receives to take down listings.<\/p>\n<p><strong>What Can Be Done?<\/strong><\/p>\n<p>Various stakeholders that can implement changes to reduce the likelihood of thieves profiting from the commercialization of others\u2019 IP. First, marketplaces should partner with companies like DeviantArt, which have created <a href=\"https:\/\/www.deviantart.com\/team\/journal\/DeviantArt-Protect-Helping-Safeguard-Your-Art-884278903\">machine-learning software<\/a> to scan public blockchains and third-party marketplaces and inform users of any potential infringement. This recommendation would still require artists to verify the results and report an infringement to marketplaces. However, artists would be aware of the infringement and could use their platforms to inform consumers of the scam. Second, marketplaces need to overhaul their process for verifying listings. For example, <a href=\"https:\/\/www.wired.co.uk\/article\/nft-fraud-qinni-art\">after a dead artist\u2019s work was stolen from Instagram and sold on the marketplace Twinci<\/a>, it updated its requirements for listers to \u201cprovide their names, a photo of themselves, proof of them creating the work, and a digital portfolio.\u201d Third, consumers should do their due diligence by reaching out to artists to verify the authenticity of the NFT before purchasing. Alternatively, consumers should purchase from auction houses like Christie\u2019s or Sotheby\u2019s to reduce the likelihood of buying a fake.<\/p>\n<p>Incorporating these changes will require significant investment from stakeholders. However, since art is a cultural tool and an economic driver, those who create work should be protected by all invested
