If you left your house within the last 3 weeks, you have heard of the film Top Gun: Maverick<\/em>. The film is a sequel to the 1986 Top Gun,<\/em> and has become Paramount\u2019s second highest grossing film, and Tom Cruise\u2019s biggest film ever<\/a>.<\/p>\n

As of June 6, 2022 a claim<\/a> has been filed by Shosh Yonay and Yuval Yonay against Paramount Pictures Corporations for all \u201cgains, profits and advantages Paramount has derived\u201d<\/a> from the Top Gun<\/em> sequel. Shosh and Yuval are also seeking injunctive relief<\/a> from production, reproduction, distribution or exploitation of Top Gun: Maverick. <\/em>In their response, Paramount has said in response that \u201c[t]hese claims are without merit and [it] will vigorously defend [itself].\u201d<\/a>\u00a0<\/p>\n

Shosh and Yuval Yonay are the widow and son of Ehud Yonay, respectively. Ehud Yonay authored the 1983 California magazine article<\/a> that inspired Top Gun<\/em>. Shosh and Yuval claim that Paramount has infringed on the copyright to Ehud\u2019s article which they own as of January 24th<\/sup>, 2020. Shosh and Yuval filed a statutory notice of termination under the Copyright Act in 2018, reclaiming copyright to the story<\/a> they are heirs to and which took effect in 2020. Per s. 203 of the Copyright Act<\/em><\/a>, authors have the right to terminate grants of copyright after thirty-five years.<\/p>\n

While Paramount owned exclusive movie rights to the \u201cTop Gun\u201d story from Ehud\u2019s article at the time of Top Gun<\/em>, Shosh and Yuval claim<\/a> that Paramount deliberately ignored the 2020 reversion of the copyright to them. \u00a0Paramount has denied<\/a> that Top Gun: Maverick<\/em> was obviously derived from the Ehud\u2019s article, and argue that the film was \u201csufficiently completed\u201d when the copyright reverted. Shosh and Yuval say<\/a> this is a \u201cdisingenuous attempt\u201d and that the sequel was in fact completed in May 2021. While Top Gun: Maverick<\/em> was originally planned<\/a> to release in July 2019, the film was postponed a year<\/a> to complete production, and then postponed another two years<\/a> due to the pandemic.<\/p>\n

Notably, Shosh and Yuval\u2019s legal team are leading professionals in copyright law. Their attorneys are Marc Toberoff, \u201ca veteran of copyright termination battles with the major studios\u201d<\/a>, and Alex Kozinski, a \u201cprominent former judge\u201d<\/a> and \u201cknown movie buff who has cultivated a copyright litigation specialty.\u201d<\/a><\/p>\n

Toberoff explains that s. 203 of the Copyright Act<\/em><\/a> allows authors to \u201cparticipate in some meaningful way in the fruits of their labor.\u201d<\/a> Toberoff also says that Paramount didn\u2019t \u201ceven attempt for any sum of money to relicense the rights to the story.\u201d<\/a>\u00a0<\/p>\n

This case raises the interesting question of whether copyright infringement is possible where the completion of the work was delayed until after the copyright\u2018s reversion partly due to the global pandemic.
