Hypothetically, these parties could succeed in raising different copyright defences in Canada.<\/p>\n<p>Senate Majority Leader Reid is being sued by Angle for the republication of her former campaign website under a new URL, \u201c<a href=\"http:\/\/www.therealsharronangle.com\/\">http:\/\/www.therealsharronangle.com\/<\/a>,\u201d which she originally removed and replaced with a reformulated, less inflammatory version of her platform. Reid has chosen the defences of fair use and freedom of speech, under political speech and parody.<\/p>\n<p><!--more--><\/p>\n<p>Although our <a href=\"http:\/\/en.wikipedia.org\/wiki\/Fair_dealing\">fair dealing defence<\/a> is <a href=\"http:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=1014404\">in some ways narrower<\/a> than the American version of <a href=\"http:\/\/www.law.cornell.edu\/uscode\/17\/usc_sec_17_00000107----000-.html\">fair use<\/a>, Reid\u2019s case may have actually been stronger were his lawsuit tried in Canada. The reposted website could be deemed as a <a href=\"http:\/\/huffingtonpost.com\/2010\/07\/06\/reid-republishes-angles-o_n_637018.html\">satirical reframing<\/a> of Angle\u2019s political platform. But Reid reposted the entire website in a parodic way that is not an enumerated defence in Canada. Cases have been made for both <a href=\"http:\/\/www.jstor.org\/stable\/1341457\">broad<\/a> and <a href=\"http:\/\/www.jstor.org\/stable\/724401\">narrow<\/a> parodic exceptions, and interestingly, Bill C-32 includes an amendment of <a href=\"http:\/\/laws.justice.gc.ca\/eng\/C-42\/page-3.html\">s.29 of the <em>Copyright Act<\/em><\/a> featuring expansive allowances for <a href=\"http:\/\/www2.parl.gc.ca\/HousePublications\/Publication.aspx?Docid=4580265&amp;File=39#5\">parody and satire<\/a>.<\/p>\n<p>Angle recently routed Reid\u2019s campaign on the fundraising front, bringing in <a href=\"http:\/\/voices.washingtonpost.com\/thefix\/senate\/sharron-angle-raised-14-millio.html\">$14 million over the last three months<\/a>, though her campaign is still troubled by a <a href=\"http:\/\/media.lasvegassun.com\/media\/pdfs\/blogs\/documents\/2010\/09\/05\/rhavenangle.pdf\">lawsuit instigated by a copyright enforcement company, Righthaven LLC<\/a>. It seeks statutory damages and the forfeiture of her domain name due to Angle\u2019s republication of <a href=\"http:\/\/media.lasvegassun.com\/media\/pdfs\/blogs\/documents\/2010\/09\/05\/rhavenangleexhibit.pdf\">entire articles<\/a> from the <a href=\"http:\/\/www.lvrj.com\/\">Las Vegas Review Journal<\/a> on her campaign website.<\/p>\n<p>Were that case to have unfolded in Canada, Angle could have tried a fair dealing argument. However, like Reid, she too would have to show that she reposted the allegedly infringing article for the <a href=\"http:\/\/laws.justice.gc.ca\/eng\/C-42\/page-3.html#anchorbo-ga:1_III-gb:s_29\">purpose of research, private study, criticism, review, or news reporting<\/a>.
