There\u00a0is no need for a metaphysical predicate, because people are good enough to agree on reasonable terms by which to live together politically. In\u00a0this talk, I recover a meaning for Schmitt's line. and thereby demonstrate the continuing need for political theology. Schmitt had hold of the\u00a0important idea that in law the most important decision precedes, rather than follows, interpretation. Decision is the condition of interpretation,\u00a0not because morality precedes politics, but because every interpretation must take a position on the relationship of\u00a0<a style=\"color: #0f3647\" href=\"https:\/\/www.yorku.ca\/osgoode\/lrst\/wp-content\/uploads\/sites\/969\/2018\/09\/Photo_Paul-Kahn.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-504 size-medium\" src=\"https:\/\/www.yorku.ca\/osgoode\/lrst\/wp-content\/uploads\/sites\/969\/2018\/09\/Photo_Paul-Kahn-200x300.jpg\" alt=\"Image of Professor Paul Kahn.\" width=\"200\" height=\"300\" \/><\/a>freedom to order. We must\u00a0decide whether law is project or system, whether the sovereign is transcendent or immanent. A transcendent popular sovereign takes up law\u00a0as a project; animmanent popular sovereign expresses law as system.<\/p>\n<p><strong>Paul Kahn\u00a0<\/strong>is Robert W. Winner Professor of Law and the Humanities, and\u00a0Director of the Orville H. Schell. Jr. Center for International Human Rights at\u00a0Yale Law School. Kahn works in the areas of constitutional law and theory,\u00a0international law, cultural theory and philosophy and is the author of\u00a0numerous books, including <em>Political Theology: Four New Chapters on the\u00a0Concept of Sovereignty<\/em> (Columbia. 2011) and <em>Making the Case: The Art of the\u00a0Judicial Opinion<\/em> (Yale, 2016).<\/p>\n<p><em>In collaboration
