{"id":3153,"date":"2015-01-08T12:30:42","date_gmt":"2015-01-08T17:30:42","guid":{"rendered":"http:\/\/ipo.info.yorku.ca\/?page_id=3153"},"modified":"2026-03-11T14:45:29","modified_gmt":"2026-03-11T18:45:29","slug":"fippa-for-faculty-1-recordkeeping-principles","status":"publish","type":"page","link":"https:\/\/www.yorku.ca\/unit\/ipo\/tool-and-tips\/fippa-for-faculty-1-recordkeeping-principles\/","title":{"rendered":"FIPPA for Faculty 1: FIPPA and Recordkeeping Principles"},"content":{"rendered":"\n<p>For additional information on topics covered in this document, consult the <a href=\"https:\/\/www.yorku.ca\/unit\/ipo\/\">Information and Privacy Office<\/a> website, other <a title=\"Tools and Tips\" href=\"https:\/\/www.yorku.ca\/unit\/ipo\/tool-and-tips\/\">Tip Sheets<\/a> and the <a href=\"http:\/\/crs.apps06.yorku.ca\">Common Records Schedule<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">FIPPA - Fundamental Principles<\/h2>\n\n\n\n<p>Ontario\u2019s <em><a href=\"http:\/\/www.e-laws.gov.on.ca\/html\/statutes\/english\/elaws_statutes_90f31_e.htm\">Freedom of Information and Protection of Privacy Act<\/a><\/em> (FIPPA) has two main principles:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Access<\/strong>: to provide the public with a right of access to information in the custody or under the control of institutions; and<\/li>\n\n\n\n<li><strong>Privacy<\/strong>: to protect the privacy of individuals\u2019 personal information held by institutions and provide a right of access by individuals to their own personal information.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Recordkeeping Principles<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>University Records<\/strong><\/h3>\n\n\n\n<p>These are records within the University\u2019s custody or control and can include records in all formats and media relating to the University\u2019s operation and administration and records containing information relating to individual faculty, staff and students.<\/p>\n\n\n\n<p>University records include items created by faculty members in their capacity as a University administrator, committee member, department chair and so on.University records may be the subject of an access to information request under FIPPA, and may be required to be disclosed to requesters pursuant to specific exemptions and exclusions in FIPPA.<\/p>\n\n\n\n<p><span style=\"color: #e31837;\"><strong>Tip <\/strong><i class=\"fa fa-check-circle\"><br><\/i><\/span> <strong>Keep University records and file in the department or Faculty recordkeeping system. <\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Remember that requests may be made for access to University records that you have created and kept<\/li>\n\n\n\n<li>Ensure that these records may be easily located<\/li>\n\n\n\n<li>Don\u2019t keep these records for longer than required. For guidance on how long to keep University records, ask departmental or decanal administrative staff, or refer questions to the Information and Privacy Office at <a href=\"mailto:info.privacy@yorku.ca\">privacy@yorku.ca<\/a>.<\/li>\n<\/ul>\n\n\n\n<p><strong>Note<\/strong> that certain records are excluded from FIPPA, including but not limited to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Records about or associated with research<\/li>\n\n\n\n<li>Records of teaching materials<\/li>\n\n\n\n<li>Labour relations and employment related records, with limited exceptions<\/li>\n\n\n\n<li>Private (non-University) donations to the University Archives<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Transitory Records<\/strong><\/h3>\n\n\n\n<p>These are records which have no ongoing operational, informational, evidential or historical value and include notes, working papers and preliminary drafts as well as convenience or duplicate copies of material \u2013 paper or electronic. In most instances, transitory records need not be retained after the task or event to which they relate has concluded.<\/p>\n\n\n\n<p><span style=\"color: #e31837;\"><strong>Tip <\/strong><i class=\"fa fa-check-circle\"><br><\/i><\/span> <strong>Delete or destroy transitory records when they are of no further use.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Personal Records<\/strong><\/h3>\n\n\n\n<p>These can be truly personal or can relate to your work as a researcher and teacher, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Research and study notes<\/li>\n\n\n\n<li>Teaching materials<\/li>\n\n\n\n<li>Manuscripts and publications<\/li>\n\n\n\n<li>Autobiographical materials such as your <em>curriculum vitae<\/em>, degrees, honours or awards received<\/li>\n\n\n\n<li>Personal communications, such as communications with editors, publishers or professional societies, or with colleagues about your academic work<\/li>\n<\/ul>\n\n\n\n<p><span style=\"color: #e31837;\"><strong>Tip <\/strong><i class=\"fa fa-check-circle\"><br><\/i><\/span> <strong><strong>Keep your personal records separate from University records. <\/strong>You decide how long to retain your own personal records.<\/strong><\/p>\n\n\n\n<p><strong>Note<\/strong> that the University Archives may be interested in acquiring the records of individuals associated with the University whose papers possess enduring value.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">University Records Containing Personal Information<\/h2>\n\n\n\n<p>University records can contain personal information, which includes an individual\u2019s name + home address, home telephone number, identifying numbers (e.g. student number or SIN), education or health history, opinions of another person about the individual, etc.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Keep University records containing personal information for at least one year after last use and only for as long as there is operational need for them.<\/li>\n\n\n\n<li>Keep personal information records in your custody in a secure location. Ensure that access is limited appropriately to those University employees who need the information in the performance of their duties. Dispose of records containing personal information securely.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Email and Voice Mail<\/h2>\n\n\n\n<p>Email messages are also considered University records if they contain information that relates to the operation and administration of the University. Examples include email about work on University committees or email created in the course of administrative duties. Some email may be excluded \u2013 see the Note under item 2.1 above. If voice mail messages are saved as electronic records, the same rules apply as to email.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Keep your email communications factual and objective \u2013 email may be the subject of an access to information request under FIPPA.<\/li>\n\n\n\n<li>Always be cautious about including others\u2019 personal information in email messages.
