{"id":256553,"date":"2018-10-04T19:31:38","date_gmt":"2018-10-04T23:31:38","guid":{"rendered":"https:\/\/yfiledev.uit.yorku.ca\/?p=256553"},"modified":"2025-04-03T13:13:00","modified_gmt":"2025-04-03T17:13:00","slug":"law-professor-considers-real-win-of-high-stakes-metis-court-case","status":"publish","type":"post","link":"https:\/\/www.yorku.ca\/yfile\/2018\/10\/04\/law-professor-considers-real-win-of-high-stakes-metis-court-case\/","title":{"rendered":"Law professor considers real 'win' of high-stakes M\u00e9tis court case"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">When an Indigenous person enters the Canadian legal system, they are coming face to face with the establishment, or superstructure, that has a long history of perpetrating injustices against their people. Such was the 2016 <\/span><i><span style=\"font-weight: 400;\">Daniels v. Canada<\/span><\/i><span style=\"font-weight: 400;\"> case, a highly contentious case that played out in the Supreme Court of Canada about M\u00e9tis status.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Osgoode Hall Law School Professor Signa A. Daum Shanks considers the effects that have developed after the release of this pivotal case, which is, on the surface, considered a legal victory. She uses the case to delve deeply into the aftermath of colonialism, the modern plight of Indigenous Peoples and the rule of law. In doing so, she unpacks complex ramifications around the legal ruling. Her article, \u201cThe Wastelander Life: Before and After the Release of <\/span><i><span style=\"font-weight: 400;\">Daniel v. Canada<\/span><\/i>,\u201d <span style=\"font-weight: 400;\">was published in the <\/span><i><span style=\"font-weight: 400;\">Osgoode Hall Law Journal<\/span><\/i><span style=\"font-weight: 400;\"> (Summer 2017).<\/span><\/p>\n<div id=\"attachment_256556\" style=\"width: 510px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-256556\" class=\"size-full wp-image-256556\" src=\"https:\/\/yfile.news.yorku.ca\/files\/2018\/10\/Feathers.jpg\" alt=\"\" width=\"500\" height=\"307\" srcset=\"https:\/\/www.yorku.ca\/yfile\/wp-content\/uploads\/sites\/889\/2018\/10\/Feathers.jpg 500w, https:\/\/www.yorku.ca\/yfile\/wp-content\/uploads\/sites\/889\/2018\/10\/Feathers-400x246.jpg 400w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><p id=\"caption-attachment-256556\" class=\"wp-caption-text\">This Osgoode publication unpacks the complex ramifications around the legal ruling on M\u00e9tis status<\/p><\/div>\n<p><span style=\"font-weight: 400;\">This is Daum Shanks\u2019 areas of expertise. She is a leader in the study of Indigenous Peoples and the legal profession, Indigenous slavery in Canada, the existence of M\u00e9tis treaties, microhistory, competing Aboriginal claims, the role of Indigenous history as evidence and the future of Indigenous Peoples\u2019 influence upon sustainable development.\u00a0<\/span><\/p>\n<h3>Like Riel, Daniels sought to include the M\u00e9tis in the Constitution<\/h3>\n<div id=\"attachment_256557\" style=\"width: 360px\" class=\"wp-caption alignleft\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-256557\" class=\"size-full wp-image-256557\" src=\"https:\/\/yfile.news.yorku.ca\/files\/2018\/10\/DaumShanks.jpg\" alt=\"\" width=\"350\" height=\"221\" \/><p id=\"caption-attachment-256557\" class=\"wp-caption-text\">Signa A. Daum Shanks<\/p><\/div>\n<p><span style=\"font-weight: 400;\">Harry Daniels (1940-2004) was an Indigenous leader, one of the founding members of the Saskatchewan M\u00e9tis Society. He was twice elected the national leader of the Congress of Aboriginal Peoples. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Like Louis Riel, he sought to include the M\u00e9tis in Canada\u2019s Constitution. Fed up with historically inaccurate, non-M\u00e9tis definitions of M\u00e9tis as \u201cin between\u201d or the \u201cmiddle ground\u201d between Indigenous and French, he decided to take Canada to court to get judicial\/legal recognition of this mislabelling. <\/span><\/p>\n<div id=\"attachment_256559\" style=\"width: 236px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-256559\" class=\"size-medium wp-image-256559\" src=\"https:\/\/yfile.news.yorku.ca\/files\/2018\/10\/DanielsH-226x300.jpg\" alt=\"\" width=\"226\" height=\"300\" \/><p id=\"caption-attachment-256559\" class=\"wp-caption-text\">Harry Daniels. Image reproduced with permission of the Congress of Aboriginal Peoples<\/p><\/div>\n<p><span style=\"font-weight: 400;\">\u201cHe wanted to make the point that M\u00e9tis people had been misclassified for years, hurt by those actions and then denied the benefits such a classification should have provided,\u201d Daum Shanks explains.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Daniels argued that when the nation of Canada came into being (1867), the Crown labelled the M\u00e9tis as First Nations. But decades later, the country refused to admit that M\u00e9tis were part of the original group in question, and failed to follow through with certain responsibilities. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Daniels, therefore, put forward three declarations to adjust modern understandings of the M\u00e9tis: <\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">M\u00e9tis and non-status Indians are \u201cIndians\u201d under section 91(24) of the <\/span><i><span style=\"font-weight: 400;\">Constitution Act, 1867.<\/span><\/i><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The federal government owes a fiduciary duty to M\u00e9tis and non-status Indians.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">M\u00e9tis and non-status Indians have the right to consultations and negotiations with the federal government respecting all their rights, interests and needs as Aboriginal Peoples.<\/span><\/li>\n<\/ol>\n<h3>Law professor analyzes the \"win\"<\/h3>\n<p><span style=\"font-weight: 400;\">Although he passed away before the case concluded, Daniels won the legal battle: the court ruled that M\u00e9tis and non-status Indians are \u201cIndians\u201d for the purpose of s. 91(24) of the <\/span><i><span style=\"font-weight: 400;\">Constitution Act, 1867<\/span><\/i><span style=\"font-weight: 400;\">. For this reason, the<\/span> <span style=\"font-weight: 400;\">case is considered as a \"win\" and positioned as another successful chapter in the pursuit of reconciliation. \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Daum Shanks, however, finds this a murky win. This ruling, she explains, means that M\u00e9tis and non-status Indians are not ruled under the <\/span><a href=\"http:\/\/www.thecanadianencyclopedia.ca\/en\/article\/indian-act\/\"><i><span style=\"font-weight: 400;\">Indian Act<\/span><\/i><\/a>\u00a0\u2013<span style=\"font-weight: 400;\">\u00a0the principal statute through which the federal government administers Indian status. M\u00e9tis people are not granted Indian status, in other words. Due to this lack of status, M\u00e9tis people cannot live on reserves. Instead, M\u00e9tis and non-status Indians should turn to the federal government for programs and services, which were not offered before <\/span><i><span style=\"font-weight: 400;\">Daniels v. Canada<\/span><\/i><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Daum Shanks notes that this ruling could lead to 200,000 additional people being recognized as M\u00e9tis (since 200,000 people would now identify themselves as such) and 200,000 non-registered First Nations who will now live off-reserve. In this light, the decision could be seen as an incentive for Indigenous people to move off the reserves. This could undermine the economic viability of the reserves, Dam Shanks warns. <\/span><\/p>\n<div id=\"attachment_256561\" style=\"width: 510px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-256561\" class=\"wp-image-256561 size-full\" src=\"https:\/\/yfile.news.yorku.ca\/files\/2018\/10\/SupremeCourtofCanada.jpg\" alt=\"\" width=\"500\" height=\"285\" srcset=\"https:\/\/www.yorku.ca\/yfile\/wp-content\/uploads\/sites\/889\/2018\/10\/SupremeCourtofCanada.jpg 500w, https:\/\/www.yorku.ca\/yfile\/wp-content\/uploads\/sites\/889\/2018\/10\/SupremeCourtofCanada-400x228.jpg 400w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><p id=\"caption-attachment-256561\" class=\"wp-caption-text\">Supreme Court of Canada<\/p><\/div>\n<p><span style=\"font-weight: 400;\">Some Indigenous scholars strongly question the \u201csuccess\u201d of <\/span><i><span style=\"font-weight: 400;\">Daniel vs. Canada<\/span><\/i><span style=\"font-weight: 400;\">, claiming that the ruling was rooted in a racist logic and it would mean a \u201croad to nowhere\u201d for many Indigenous people. Daum Shanks weighs in more prudently however, and argues that the wins of this case are hard to see. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">On one hand, she recognizes some restorative value to the case. \u201cGiven the number of times courts have allowed the Crown\u2019s view of history to prevail, <\/span><i><span style=\"font-weight: 400;\">Daniels v. Canada<\/span><\/i><span style=\"font-weight: 400;\"> contains a sense of optimism. In this way, the ruling sends a strong message,\u201d she says, although she also believes that early signs of progress don\u2019t always last. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">On the other hand, Daum Shanks points out that the decision reinforced the underlying problem that Daniels came to argue in the first place: M\u00e9tis should define themselves, not be defined by the Court. In this way, <\/span><i><span style=\"font-weight: 400;\">Daniels v. Canada<\/span><\/i><span style=\"font-weight: 400;\"> ultimately conflicts with M\u00e9tis-based sources. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Daum Shanks believes that the case leaves the M\u00e9tis in a kind of limbo. \u201cIn 1867, it might have been Canada that placed us there.
